Welcome to E-Bike A Go-Go. These Terms of Service ("Terms") govern your access to and use of www.e-bikeagogo.com (the "Site") and the products and services we offer, including e-bike and accessory sales, golf-cart rentals, repairs, trade-ins, and demo rides. By using our Site or purchasing from us, you agree to these Terms. If you do not agree, please do not use the Site or our services.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase or enter into a rental agreement with us. By using our services, you represent that you meet this requirement.

2. Products and Pricing

  • We make every effort to display our products, descriptions, and prices accurately. However, we do not warrant that product descriptions, pricing, or other content on the Site is error-free, complete, or current.
  • All prices are in U.S. dollars and are subject to change without notice.
  • We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the Site is inaccurate, including after an order has been submitted.
  • Product availability is not guaranteed and is subject to stock on hand.

3. Orders and Payment

  • Your submission of an order constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason.
  • Payment must be received or financing approved before an order is fulfilled or a product is released.
  • You are responsible for providing accurate and complete billing and contact information.

4. Financing

We offer financing through a third-party provider (Synchrony) for qualified buyers. Financing is subject to credit approval and the terms, conditions, and privacy practices of the financing provider. E-Bike A Go-Go is not the lender and is not responsible for financing decisions, terms, or servicing. Any promotional financing offer (such as 0% APR for qualified buyers) is provided by and subject to the terms of the financing provider.

5. Shipping, Pickup, and Assembly

  • Certain products include assembly, as noted on the product page.
  • Shipping timelines are estimates and are not guaranteed. We are not responsible for delays caused by carriers or events outside our control.
  • Risk of loss passes to you upon delivery or in-store pickup.

6. Rentals (Golf Carts and Other Equipment)

Rentals are subject to a separate rental agreement signed at the time of rental. By renting equipment from us, you agree that:

  • You are responsible for the rented equipment during the rental period and will return it in the same condition, ordinary wear excepted.
  • You assume all risk associated with the operation of rented equipment and agree to operate it safely, lawfully, and in accordance with all instructions provided.
  • You are responsible for any loss, theft, or damage to the equipment during the rental period, and for any damage or injury caused to third parties arising from your use.
  • Additional rental terms, deposits, age requirements, and liability provisions are set out in the rental agreement, which controls in the event of any conflict with these Terms.

7. Repairs

  • Repair services are provided based on our assessment of the equipment. Repair estimates are approximate and may change if additional issues are found.
  • We are not responsible for pre-existing conditions, or for damage arising from prior modifications, misuse, or normal wear.
  • Items left for repair must be picked up within 30 days of notification of completion. Uncollected items may be subject to storage fees or considered abandoned as permitted by law.

8. Trade-Ins

  • Trade-in values are estimates and are determined at our discretion based on the condition, age, and market value of the item.
  • We reserve the right to adjust or decline any trade-in offer after inspection.
  • By trading in an item, you represent that you are its lawful owner and that it is free of liens or claims.

9. Demo Rides and Assumption of Risk

Riding an e-bike or operating any equipment involves inherent risks, including the risk of serious injury. By participating in a demo ride or operating any product, you voluntarily assume all such risks. You agree to follow all safety instructions, wear appropriate safety equipment, obey all applicable laws, and ride within your ability. A separate waiver may be required before a demo ride.

10. Warranties

  • Products may be covered by a manufacturer's warranty. Any such warranty is provided by the manufacturer, and claims are subject to the manufacturer's terms.
  • Except as expressly stated, and to the fullest extent permitted by law, products and services are provided "as is" without warranties of any kind, express or implied, including implied warranties of merchantability or fitness for a particular purpose.

11. Limitation of Liability

To the fullest extent permitted by law, E-Bike A Go-Go and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Site, products, or services. Our total liability for any claim arising out of or relating to these Terms or our products and services will not exceed the amount you paid for the product or service giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Returns and Refunds

Returns, exchanges, and refunds are handled in accordance with our store return policy, available in store or upon request. Certain items, including custom, clearance, or used items, may be final sale. Rental fees and completed services are generally non-refundable.

14. Intellectual Property

All content on the Site, including text, graphics, logos, images, and product photos, is the property of E-Bike A Go-Go or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or use our content without our prior written permission.

Our Site may link to third-party websites and services. We are not responsible for the content, products, or practices of those third parties, and linking does not imply endorsement.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or our services will be subject to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.
